Contractual Agreement

This agreement is between, Global Prospects SL, Registered in Spain, Company Number B92621457, whose registered office is at Calle Santa Barbara 1, Edif River Playa Local 2, Fuengirola, (Malaga) 29640, Spain and who publish the Website www.propertyshowrooms.com (Referred to herein after as Propertyshowrooms.com) and The Principal (herein after referred to as the Advertiser or the Client, whether this be an individual, or a company using any of the Propertyshowrooms.com services).

Terms and Conditions

1. Interpretations

  • 1.1 In this Agreement, unless the context otherwise requires:
  • 1.1.1 Words denoting the singular shall include the plural and vice versa.
  • 1.1.2 Words denoting any gender shall include all genders.
  • 1.1.3 References to persons shall include firms, corporations and other associations or bodies of persons whether or not incorporated and any government, state or agency of a state whether or not any of the foregoing has any separate legal personality.
  • 1.1.4 Any reference to a statute or statutory provision shall be construed as including a reference to any statutory modification, consolidation or re-enactment (whether before or, in the case of consolidation or re-enactment only, after the date hereof) from time to time and shall include reference to any provision of which it is a re-enactment (whether with or without modification) and any bye-laws, statutory instruments, rules, regulations, orders, directions, consents and permissions made or given there under and any conditions attaching thereto.
  • 1.1.5 Clause headings are for ease of reference only and shall not affect the construction or interpretation of this Agreement.
  • 1.1.6 Any reference to clauses, sub-clauses and paragraphs are to clauses, sub-clauses and paragraphs of this Agreement;

2. Shipping policy

  • 2.1 Propertyshowrooms.com is a property advertising lead-generation and web traffic generation company, shipping virtual goods in the way of instant internet traffic directed to the Advertisers' website and authorised client details provided via email sent as soon as is physically possible to the Advertisers' registered email addresses.
  • 2.2 Propertyshowrooms.com takes no responsibility for any loss of lead or internet traffic delivery caused as a result of incorrect information supplied by the Advertisers’ or any technical difficulties experienced by the Advertiser´ IT infrastructure email server problem., including but not limited to; e-mail server functionality, e-mail deliverability and spam settings, incorrect email addresses, internet connectivity, website availability etc.

3. Duration and termination

  • 3.1 Propertyshowrooms.com reserves the right to terminate any agreement under, but not limited to the following conditions,
  • 3.1.1 If the Advertiser has attempted to use Propertyshowrooms.com and/or the Services and/or the system for any purpose other than those expressly contemplated herein under.
  • 3.2 Termination of this Agreement, howsoever caused, shall:
  • 3.2.1 Be without prejudice to any rights or liabilities accrued at the date of termination;
  • 3.2.2 Result in the deactivation by Propertyshowrooms.com of all Property Information uploaded by The Advertiser onto Propertyshowrooms.com.
  • 3.3 Upon termination of this agreement for any reason:
  • 3.3.1 The rights granted to The Advertiser herein shall terminate; and
  • 3,3,2 The Advertiser shall immediately cease all use of the Services.
  • 3.3.3 All provisions of this Agreement which, in order to give effect to their meaning, need to survive its termination shall remain in full force and effect thereafter.

4. Amendment

  • 4.1 Alterations, modifications, amendments or additions to this Agreement will be made from time to time, it is suggested that The Advertiser checks the terms and conditions when The Advertiser logs in, Propertyshowrooms.com do not notify updates or changes individually.

5. Force majeure

  • 5.1 The obligations of each party under this Agreement shall be suspended during the period and to the extent that that party is prevented or hindered from complying with them by any cause beyond its reasonable control, including (but without prejudice to the generality of the foregoing expression) strikes, lock-outs, labour disputes, act of God, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood and storm.
  • 5.2 In the event of either party being so hindered or prevented, the party concerned shall give notice of suspension to the other party as soon as is reasonably possible, stating the date and extent of the suspension and its cause, and the omission to give such notice shall forfeit the rights of that party to claim suspension.
  • 5.3 Any party whose obligations have been suspended as aforesaid shall resume the performance of those obligations as soon as is reasonably possible after the removal of the cause and shall so notify the other party.
  • 5.4 In the event that the cause continues for more than 3 months, either party may terminate this Agreement by giving the other party 30 days' notice.

6. Assignment

  • 6.1 The Advertiser shall not without the prior written consent of Propertyshowrooms.com assign or transfer this Agreement or its rights under it.

7. Waiver

  • 7.1 The failure of a party to exercise or enforce any right under this Agreement shall not be deemed to be a waiver of that right, nor operate to bar the exercise or enforcement of it at any time or times thereafter.

8. Severability

  • 8.1 The illegality, invalidity or unenforceability (in whole or in part) of any provision of this Agreement shall not affect the other provisions, and the other provisions of this Agreement and the remainder of the affected provisions shall continue to be valid.
  • 8.2 The parties agree to use their best endeavours to negotiate in good faith and agree a valid and enforceable provision with a similar effect to the affected provision so far as that is possible.

9. No partnership

  • 9.1 Nothing in this Agreement or any document referred to in it or any arrangement contemplated by it shall be construed as creating a partnership between the parties for any purpose whatsoever and neither party shall have the power or authority to bind the other party or impose any obligations on it to the benefit of any third party.

10. Liability

  • 10.1. The following provisions set out the entire financial liability of Propertyshowrooms.com (including any liability for the acts or omissions of its employees, agents and sub-contractors) to the Advertiser in respect of:
  • 10.1.1. Any breach of this Agreement; and,
  • 10.1.2. Any representation, statement or tortuous act or omission including negligence arising under or in connection with this Agreement.
  • 10.2. All warranties, representations, guarantees, conditions and terms other than those expressly set out in this Agreement, whether express or implied by statute, common law, trade usage or otherwise, and whether written or oral, are hereby, to the fullest extent permitted by law, expressly excluded from this Agreement.
  • 10.3. Nothing in this Agreement excludes or limits the liability of either party for:
  • 10.3.1. Death or personal injury caused by its negligence; or
  • 10.3.2. Any matter which it would be illegal for either party to exclude or attempt to exclude its liability; or
  • 10.3.3. Fraud or fraudulent misrepresentation.
  • 10.4. For the avoidance of doubt, both parties acknowledge and agree that:
  • 10.4.1. Propertyshowrooms.com is not representing that the use of and access to the Services and/or Propertyshowrooms.com shall guarantee any increase in the number of Sales made by The Advertiser.
  • 10.4.2. Whilst Propertyshowrooms.com will increase the exposure of The Advertiser’s property/ies to potential buyers, Propertyshowrooms.com can make no guarantees that a sale or enquiries will occur.
  • 10.5. Propertyshowrooms.com total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise, arising in connection with the performance or contemplated performance of this Agreement shall be limited to 500 Euro.
  • 10.6. The Advertiser acknowledges that Propertyshowrooms.com is not obliged to conduct any independent investigations to verify the accuracy of Property Information uploaded by Advertisers’ onto Propertyshowrooms.com. Propertyshowrooms.com accepts no liability in relation to the content of such Property Information, to include, without limitation, liability. All such liability rests with The Advertiser.
  • 10.7. The Advertiser shall indemnify and keep Propertyshowrooms.com indemnified against any and all losses arising in connection with this Agreement, to include, without limitation, all claims, actions, damages, costs and expenses arising from the content of any Property Information.
  • 10.8. Propertyshowrooms.com (including its respective agents and sub-contractors) shall not be liable to the Advertiser for any indirect, special, incidental or consequential damages, to include, without limitation, loss of profits, loss of data, business interruption, loss of use, loss of contracts, loss of goodwill (whether direct or indirect) whether or not caused by or resulting from Propertyshowrooms.com negligence, a breach of Propertyshowrooms.com statutory duties or a breach of Propertyshowrooms.com obligations, howsoever caused, even if Propertyshowrooms.com is advised of the possibility of such loss.
  • This and the previous clause (10.7) shall survive termination of this Agreement.

11. Intellectual property

  • 11.1. The Advertiser acknowledges and agrees that all right, title and interest in and all Intellectual Property Rights in the Services and/or Propertyshowrooms.com are and shall remain the exclusive property of Propertyshowrooms.com.
  • 11.2. Propertyshowrooms.com acknowledges that all Intellectual Property Rights in the Property Information uploaded by The Advertiser onto Propertyshowrooms.com are and shall remain the exclusive property of The Advertiser or the company for whom The Advertiser acts.
  • 11.3. The Advertiser shall indemnify and keep Propertyshowrooms.com indemnified against any and all losses arising from any claims brought against Propertyshowrooms.com that Property Information supplied by The Advertiser and uploaded onto Propertyshowrooms.com infringes the Intellectual Property Rights of a third party.

12.Jurisdiction and disputes

  • 12.1. The terms set out in this Agreement shall be governed and construed by the laws of Spain and the parties hereby agree to submit to the exclusive jurisdiction of the Spanish Courts.

13. General

  • 13.1. Propertyshowrooms.com will endeavour to filter out spam, invalid or fraudulent enquiries. However, Propertyshowrooms.com can make no guarantee for the legitimacy of internet based enquiries.

14. Data Protection Rights (LOPD)

  • 14.1 Complying with the Act 34/2002 of 11th June regarding Company Services for Information and Electronic Commerce, we would inform you that Global Prospects, S.L., domiciled at C/ Sta. Bárbara 1, Edif. River Playa Local 2 - 29640 Fuengirola - Málaga – Spain and inscription number CIF B 92621457 in the Registry Mecantil de Málaga, Volume 2.441, Book 1.354, Page 155, Section MA-39.394 is the title owner of this website.
  • 14.2 According to the provisions of the Spanish Organic Act 15/1999 regarding Personal Data Protection, in the event that an e-mail is sent to us to the address shown in the same, or that a data collection form is filled in, we would inform you that the personal data given to us will be registered in the file for which Global Prospects, S.L. is responsible. The purpose of the same is to deal with the enquiry, maintain a commercial relationship and to send by any means including by e-mail, or other equivalent electronic communication, publicity or promotional information regarding the products or services of the company.
  • 14.3 You will be able to express refusal of your data being processed for publicity purposes and to exercise the rights of access, rectification, cancellation and opposition in accordance with that established in current legislation, by writing to the following address: C/ Sta.   • 14.4 Global Prospects, S.L. declares that it has adopted all the necessary and relevant security measures as established in the Spanish Royal Decree 1720/2007 of 21st December, by which the Regulatory Decree implementing the LOPD [Ley Orgánica de Protección de Datos – Spanish Personal Data Protection Act] was approved, and that it has established all technical methods within its means to avoid the loss, wrongful use, alteration, non-authorised access or theft of the data you may supply.
  • 14.5 All the contents of the website, and in particular trade names, business names, industrial designs, designs, texts, photographs, graphics, logos, icons, software and any other signs that may be used in industry and business, are protected by the industrial property and intellectual rights of Global Prospects, S.L. Their use and/or reproduction are therefore prohibited without the express consent of the company.
  • 14.6 Global Prospects, S.L. will not be responsible for infringements of intellectual property or industrial rights of third parties originating from the inclusion in the website of trademarks, business names, industrial designs, patents, designs, texts, photographs, graphics, logos, icons or software corresponding to third parties who, when including them in the website, have declared they are the title owners of the same.
  • 14.7 The user is obliged to use the contents of the website in a conscientious, correct and legal manner and undertakes:
  • 14.7.1 Not to use the contents for objectives or purposes contrary to the law, to public morals and to normal customs or public order.
  • 14.7.2 Not to reproduce, copy, distribute, allow public access by whatever means of public communication, transform or modify the contents, unless the corresponding authorisation from the title owner thereof has been given.
  • 14.7.3 Not to use the contents of the website to send publicity, communications for purposes of direct sales or for any other commercial purpose, unsolicited messages sent to a multitude of people regardless of its purpose, and to abstain from marketing or divulging such information in any way.

In the event of any kind of dispute, both parties will try to come to a friendly agreement. If this is not possible the Courts of Málaga will have jurisdiction to deal with the case and the parties will not have recourse to any other jurisdiction for the purposes of legal action.

USERS WHO DO NOT AGREE WITH THIS POLICY MUST NOT INTRODUCE ANY DATA BY MEANS OF THIS WEBSITE OR ACCESS THE CONTENT OF THIS WEBSITE.

15. IVA – VAT Payments

  • 15.1. VAT – IVA (Spanish VAT) of 21% will be added to the total amount unless you have added a VAT number to your account information.
  • 15.2. The grand total value is without IVA/VAT, the IVA/VAT will be added once you have taken the products to "Checkout". If you are not an IVA-registered company in the VIES European Union database (http://ec.europa.eu/taxation_customs/vies/) and are based in the European Union, you will need to pay IVA/VAT.
  • 15.3. If you are an IVA/VAT registered company, based in the EU but outside of Spain, you can avoid paying IVA/VAT. You will need to add your IVA/VAT number to your account, before taking your products to “checkout“ – to do so, please go to the “my account” tab then click on “edit my account info” add your VAT/IVA number to the “VAT Exempt Number” field and select the country where your company is registered.


16. Propertyshowrooms.com Property Listing Service for Private Sellers (FSBO) / Agents / Developers

  • 16.1. In this section the following shall apply:
  • 16.1.1. The Advertiser (FSBO or private seller), signing up to use the Propertyshowrooms.com FSBO Listing Service is a private individual (and not a company) and has the ability to upload 5 separate pieces of real estate to promote through Propertyshowrooms.com or;
  • 16.1.2. The Advertiser (Agent) signing up to use the Propertyshowrooms.com Property Listing service is a company/agent/developer/broker with the option of uploading an unlimited amount for their sole or exclusive Real Estate listings.
  • 16.1.3. Global Prospects SL operates “Propertyshowrooms.com” containing a database of Real Estate listings for sale.
  • 16.1.4. The Advertiser wishes to enter into an agreement with Propertyshowrooms.com to market and advertise properties on Propertyshowrooms.com
  • 16.2. Properties uploaded by The Advertiser will be shown in Search Result Pages for the Town, Region and Country locations that The Advertiser specifies.
  • 16.3. The upload interface is preloaded with Countries, Regions and Towns.
  • 16.3.1. The Advertiser may request a new region or town to be added if The Advertiser wishes.
  • 16.3.2. These will be added at Propertyshowrooms.com’s discretion.
  • 16.3.3. Propertyshowrooms.com reserves the right to edit a listing and its placement where deemed fit within the structure of Propertyshowrooms.com.
  • 16.4. The Advertiser (Agent) has the option to upload a Real Estate Directory page to Propertyshowrooms.com which provides the opportunity to upload a link to The Advertisers (Agent) website.
  • 16.4.1. The Advertiser (Agent) can also display their company logo and name, contact details and description of the company and the services their company provides.
  • 16.5. Propertyshowrooms.com will provide a link to allow visitors to the website to filter search results to show only The Advertisers (Agent) listings.
  • 16.6. All properties uploaded by The Advertiser will have their own independent page on our site which is recognized by the search engines.
  • 16.7. When listing properties, all enquiries will be forwarded to The Advertiser via e-mail.
  • 16.7.1. Whilst Propertyshowrooms.com will make every effort to ensure enquiries are delivered to The Advertiser in a timely fashion via e-mail, Propertyshowrooms.com cannot accept responsibility for undelivered enquiries; however,
  • 16.7.2. The Advertiser will have access to an online record of all of his enquiries.
  • 16.8. The Advertiser must be able to provide proof where requested that he has authorization to market/list the properties he is advertising through Propertyshowrooms.com and that all properties adhere to local regulations (e.g. decree 218 in Spain – where it is necessary to hold hard copies of owners title deeds to the property etc.).
  • 16.9. The Advertiser will provide a minimum of one email address, one phone number and one contact name with whom Propertyshowrooms.com may correspond to forward enquiries.
  • 16.10. After the first listing is accepted, all further listings will be checked, although The Advertiser will only be notified by e-mail of those not complying with listing specifications and quality control checks as stated in the upload interface.
  • 16.10.1. Once The Advertiser’s first listing has been accepted and published on Propertyshowrooms.com, no recourse for refund can be made.
  • 16.11. The Advertiser is granted access to the upload interface for the upload of property listings that are for sale only. Rentals are not currently permitted through this system.
  • 16.12. Advertisements must not include claims relating to the property or proposed transaction which are not matters of fact or which cannot be checked by reasonable inspection or survey, or in the case of any legal matters, verified by relevant documents; and
  • 16.13. If The Advertiser specifies "Wheelchair Access" for a property all of the following must apply:
  • 16.13.1. No steps needed to access the property.
  • 16.13.2. Access is either level or via a ramp.
  • 16.13.3. Off-street parking or unrestricted on-street parking.
  • 16.13.4. WC and main living floors at ground level.
  • 16.13.5. Ground floor access to main living floor rooms.
  • 16.14. The upload interface states all requirements and limitations of listings, failure to comply with listing guides, image requirements and so on, can result in rejection of listings or removal from Propertyshowrooms.com at a later point.
  • 16.15. Propertyshowrooms.com reserves the right to reject any listing. Please note that The Advertiser is requested not to list properties in countries experiencing civil war or dispute, however the Propertyshowrooms.com accepts no responsibility or liability for any such dispute which may arise from the advertising and/or sale of properties by The Advertiser in disputed areas or areas experiencing civil unrest, war or boundary changes.
  • 16.16. Only single-property listings may be added to Propertyshowrooms.com under the standard Unlimited Listings product.
  • 16.16.1. It is forbidden to add a listing which is intended to sell multiple units, or an investment product other than a single actual real estate entity such as a house, villa, plot of land etc.
  • 16.16.2. Any listing advertised on Propertyshowrooms.com that is found to be not an actual single-property listing based on a verifiable single built piece of real estate can and will be removed, as per our quality control guidelines.
  • 16.17. The Advertiser should reply to all enquiries as soon as is practical to ensure that clients receive details as they request.
  • 16.18. The agreement will automatically terminate if renewal payment is not made by The Advertiser.
  • 16.18.1. The Advertiser may deactivate their properties within the uploader should they wish to cease display at any point.
  • 16.19. Propertyshowrooms.com reserves the right to add enquirers’ email addresses to certain Propertyshowrooms.com mailing lists at any time. Propertyshowrooms.com also reserves the right to re-qualify and resell enquiries after a period of 6 months has elapsed since the enquiry date
  • 16.20. By submitting advertising content to Propertyshowrooms.com The Advertiser confirms that The Advertiser is the owner of the material being submitted.
  • 16.20.1. In doing so, The Advertiser allows Propertyshowrooms.com to use this material, and submit it to third parties for publicity purposes, where applicable within the interest of promoting the advertiser’s listings.
  • 16.20.2. All materials are archived after the term of the advertiser’s listing ends, this means that they can still appear within Propertyshowrooms.com although it will clearly state that the listing is sold or unavailable, and listings will not appear in our on-page search results.
  • 16.21. The Advertiser agrees to modify the listing description of any properties where need be, in the case of price changes, or indeed remove it, if sold or no longer available.
  • 16.21.1. All changes should be made within 10 working days of The Advertiser finding out about the price changes or that the property needs to be removed.
  • 16.22. All listing descriptions must be in English only.
  • 16.23. Refunds will only be offered prior to a listing being published on Propertyshowrooms.com. If The Advertiser’s property is sold, or circumstances change prior to the end of the listing term, no part refunds will be due.
  • 16.24. All listings must have a minimum of 3 quality photographs of the property (Or artists impressions, or floor plans for off plan development, or a photo of the land or surrounding area in the case of plots of land), a minimum of 50 words of text relating to the property or the surrounding area and should be checked for spelling and grammatical errors (See the upload guide for photograph specifications and text guide).
  • 16.25. Properties should not have duplicate images (i.e. images already used for other listings on the site.)
  • 16.25.1. Properties should not display the same main image as another property
  • 16.25.2. Properties should not display the 2 identical images on the same property
  • 16.25. Propertyshowrooms.com will send renewal reminders to The Advertiser 14 days, 7 days and 3 days prior to the renewal date of the advertisers listing.
  • 16.25.1. To do this The Advertiser will need to log in and resubmit the advertiser’s payment details.

15. Terms and Conditions for all Propertyshowrooms.com Mailshots

  • 17.1. All mailshots or inclusion of properties in mailshots must be paid for in advance, 2 calendar weeks (14 days) prior to the booked send date.
  • 17.1.1. A pro-forma invoice will be issued and once payment has been confirmed, either by credit card authorisation or bank transfer confirmation, the date for mailing will be confirmed and design work (where required) will be commenced by the Propertyshowrooms.com Marketing team.
  • 17.2. Propertyshowrooms.com reserves the right to refuse any mailshot or specific piece of mailshot content in the interest of protecting the Propertyshowrooms.com database.
  • 17.2.1. All designs should be of a suitable standard to be launched and Propertyshowrooms.com reserves the right to reject designs on this basis.
  • 17.3. Whilst Propertyshowrooms.com makes every effort to keep the database accurate and up to date, Propertyshowrooms.com accepts no responsibility for open rate, click through or conversion rate. Any figures quoted with respect to the database are approximate at that time and relevant to previous experience with similar products.
  • 17.4. Propertyshowrooms.com accepts no responsibility for errors/mistakes/inaccuracies within the design of the advertisement after Propertyshowrooms.com receives written confirmation from the agent that the mailer has been “approved”.
  • 17.5. The Advertiser must be able to provide proof where requested that he has authorization to market/list the properties he is advertising through Propertyshowrooms.com and that all properties adhere to local regulations (e.g. decree 218 in Spain – where it is necessary to hold hard copies of owners title deeds to the property etc.).
  • 17.5.1. By paying for and booking a send date for a particular product, the advertiser agrees that they have performed sufficient due diligence on the product being advertised, and that the said product is a legal and valid investment product, and adheres to any relevant local laws/regulations.
  • 17.5.2. Any mailshot product that has been paid booked and paid for, but found to be in breach of section 17.5.1 above, will be rejected by Propertyshowrooms.com and the Advertiser will have no recourse for refund.
  • 17.6. All enquiries generated by the mailshot will be forwarded to the advertiser via e-mail using the notification address provided.
  • 17.6.1. Whilst Propertyshowrooms.com will make every effort to ensure enquiries are delivered to the advertiser in a timely fashion via e-mail, Propertyshowrooms.com cannot accept responsibility for undelivered enquiries.
  • 17.7. The Advertiser should reply to all enquiries as soon as is practical to ensure that clients receive details as they request.
  • 17.8. Propertyshowrooms.com will endeavour to filter out spam, invalid or fraudulent enquiries, however, Propertyshowrooms.com can make no guarantee for the legitimacy of internet-based enquiries.
  • 17.9. By submitting advertising content to Propertyshowrooms.com The Advertiser confirms that he is the owner of the material being submitted, or has the correct and relevant permissions to do so, and in doing so, The Advertiser allows Propertyshowrooms.com to use this material, and submit it to third parties for publicity purposes, where applicable, within the interest of promoting The Advertisers property.
  • 17.10. All quotations or discounts given by Propertyshowrooms.com lapse after 30 days (unless otherwise specified) unless re-confirmed in writing by an authorised agent of Propertyshowrooms.com.
  • 17.11. List prices are subject to alteration without notice and confirmation of list prices should be sought by The Advertiser when placing the order.
  • 17.12. Any variation of these conditions by The Advertiser is ineffective unless accepted in writing by a senior employee of Propertyshowrooms.com / Global Prospects.

18. Bespoke Showcase Mailer

  • 18.1. This product is an enhancement to the Propertyshowrooms.com listing service. It is subject to the Terms and Conditions of Propertyshowrooms.com listing service for FSBO / Agents / Developers, the Terms and Conditions for all Banner Advertising – In General and the Terms and Conditions for all Propertyshowrooms.com Mail shots, and the Terms and Conditions for all Propertyshowrooms.com Banner Advertisements – In General, in addition, is subject to the additional specific terms of this service outlined below and associated with this enhancement.
  • 18.2. All Bespoke Showcase Mailers will have a Propertyshowrooms.com logo and click through on them.
  • 18.2.1. Propertyshowrooms.com will include between 6 and 12 properties from The Advertiser’s account in a mailshot to the Propertyshowrooms.com Database.
  • 18.2.2. All properties on the Bespoke Showcase Mailer will only be those of The Advertisers and must advertise a single piece of real estate only, no investment products or multiple-unit listings are allowed.
  • 18.2.3. The Advertiser can feature a minimum of 6 properties up to a maximum of 12 properties per mailer.
  • 18.2.4. The Advertiser will receive a link directly to his Website by way of a Heading Link or a Banner link on the mailshot.
  • 18.2.5. Propertyshowrooms.com will include only The Advertiser’s properties and a link to The Advertiser’s Website or property details page
  • 18.2.6. Internet Traffic will be driven toward The Advertiser’s property details page for properties on the Bespoke Showcase Mailer.
  • 18.3. All Bespoke Showcase Mailers must connect through to the relevant property detail pages for the promoted products in question. 
  • 18.3.1. The properties The Advertiser wishes to feature must be a live listing on the Propertyshowrooms.com Website at least 48 hours before design work is started.
  • 18.4. Bespoke Showcase Mailers have no limit in regard to the number of properties from any one Country – The Advertiser may feature up to 10 properties to be included in any one Bespoke Showcase Mailer.
  • 18.5. All the required information for each property MUST be provided to Propertyshowrooms.com a minimum of 1 Week before the day of the send and must be completed using a Bespoke Showcase Mailer Design sheet.
  • 18.5.1. Propertyshowrooms.com will then return the copy to The Advertiser within two business days. From here The Advertiser will have one business day to proof read the final copy and return to Propertyshowrooms.com clearly stating that the mailer is “approved”. 18.5.2. Note: After proof reading the final copy The Advertiser will not be able to make any further changes to The Advertiser’s Bespoke Showcase Mailer - ready for Propertyshowrooms.com to send out on the day detailed in the agreement.
  • 18.6. Additional charges may be incurred on highly complex requests for Bespoke Showcase Mailers. These will be agreed in writing between The Advertiser and Propertyshowrooms.com / Global Prospects beforehand.

19. Showcase Property Advertisements

  • 19.1. This product is an enhancement to the Propertyshowrooms.com listing service. It is subject to the Terms and Conditions of Propertyshowrooms.com listing service for FSBO / Agents / Developers and the Terms and Conditions for all Propertyshowrooms.com Mail shots, and, in addition, is subject to the additional specific terms of this service outlined below and associated with this enhancement.
  • 19.2. All mailers will have a Propertyshowrooms.com logo and click through on them.
  • 19.2.1. Propertyshowrooms.com will include a property from The Advertiser’s account in their Showcase mailer to the Propertyshowrooms.com database.
  • 19.2.2. The advertisement will link through to The Advertiser’s chosen property detail page on Propertyshowrooms.com; all detail pages included on the Showcase must advertise a single piece of real estate only, no investment products or multiple-unit listings are allowed.
  • 19.2.3. Internet traffic will be driven toward The Advertiser’s property detail page for properties on the Showcase Mailer.
  • 19.3. All Showcase Property advertisements must connect through to the relevant pages of the properties listed on Propertyshowrooms.com i.e. The Property Details Page.
  • 19.4. Mailshots are limited so that no country is promoted more than 3 times in any one Showcase and no more than 2 properties from any one Region.
  • 19.5. All the required information for each property MUST be provided to Propertyshowrooms.com on or before 5pm Central European Time, at least 3 days before the due date of the send and must be completed on a Showcase Mailer booking form.
  • 19.5.1. Propertyshowrooms.com will then return the copy to The Advertiser within one full business day. From here The Advertiser will have one business day to proof read the final copy and return to Propertyshowrooms.com.
  • 19.5.2. Note: After proof reading the final copy The Advertiser will not be able to make any further changes to his Showcase Mailer - ready for Propertyshowrooms.com to send out on the agreed day.
  • 19.6. Additional charges may be incurred on highly complex requests for Showcase Mailers. These will be agreed in writing between the Advertiser and Propertyshowrooms.com / Global Prospects.

20. Banner Advertisements - in General

  • 20.1. All banners or inclusion of banners in mailshots must be paid for in advance.
  • 20.2. An invoice will be issued and once payment has been confirmed, either by credit card authorisation or bank transfer confirmation, the date for mailing will be confirmed and design work will be commenced by Propertyshowrooms.com.
  • 20.3. All designs should be of a suitable standard to be launched and Propertyshowrooms.com reserves the right to reject designs on this basis.
  • 20.4. Propertyshowrooms.com accepts no responsibility for errors/mistakes/inaccuracies within the design of the advertisement after Propertyshowrooms.com receives written confirmation from The Advertiser that the mailer has been “approved”.
  • 20.5. The Advertiser must be able to provide proof where requested that he has authorization to market the properties and/or provide the service that he is advertising through Propertyshowrooms.com and that any properties/services adhere to local regulations (e.g. decree 218 in Spain – where it is necessary to hold hard copies of owners title deeds to the property etc. – or FSA regulation for financial products).
  • 20.6. All Banners must connect through to the relevant page for the promoted product in question, i.e. the Advertiser cannot send a mailshot relating to property and link through to a financial product.
  • 20.7. If The Advertiser is supplying the artwork for the rotating banner, all the required information for the rotating banner MUST be provided to Propertyshowrooms.com on or before 5pm Central European Time, at least 5 working days before the due start date of the campaign.
  • 20.8. If Propertyshowrooms.com is preparing the artwork for The Advertiser’s rotating banner a minimum of 5 working days must be allowed for Propertyshowrooms.com to prepare The Advertiser’s advert and for The Advertiser to approve
  • 20.9. The Advertiser must also provide their logo and the URL (the website address) of the page where the rotating banner will link through to.
  • 20.10. Additional charges may be incurred on highly complex requests for Banner Advertising. These will be agreed in writing between The Advertiser and Propertyshowrooms.com / Global Prospects.
  • 20.11. Propertyshowrooms.com accepts no responsibility for undelivered click through’s or page views due to problems with the advertiser’s server.
  • 20.12. The Advertiser should reply to all enquiries as soon as is practical to ensure that clients receive details as they request.
  • 20.13. The Advertiser will provide a minimum of one email address, one phone number and one contact name with whom Propertyshowrooms.com may correspond to forward enquiries.
  • 20.14. By submitting advertising content to Propertyshowrooms.com The Advertiser confirms that he is the owner of the material being submitted, in doing so, The Advertiser allows Propertyshowrooms.com to use this material, and submit it to third parties for publicity purposes, where applicable, within the interest of promoting The Advertisers properties/services
  • 20.15. The Advertiser agrees to notify Propertyshowrooms.com if any claims made on the rotating banner are no longer factual or are un-applicable within 3 working days of discovering the changes.
  • 20.16. Propertyshowrooms.com will send renewal reminders to The Advertiser 14 days, 7 days and 3 days prior to the renewal date of the advert
  • 20.17. To renew the advert, The Advertiser will need to log in and resubmit the advertiser’s payment details.20.18. General Recommendations.
  • 20.18.1. Images – The larger the images The Advertiser can supply the better.
  • 20.18.2. Text – Keep it short, to the point and uncomplicated (20 words maximum).
  • 20.18.3. Use the development/service’s USP as a strapline to gain people’s attention.
  • 20.18.4. Link to the rotating banner through to a data-capture form requesting the minimum information possible from the agent.

21. Home Page Banner Advertising

  • 21.1. This product is subject to the Terms and Conditions for all Propertyshowrooms.com Mail shots, and Terms and Conditions for all Propertyshowrooms.com Banner Advertisements – In General, and, in addition, is subject to the additional specific terms of this service outlined below and associated with this enhancement.
  • 21.2. The price of a homepage rotating banner is 400 Euros per month
  • 21.3. Banners should be sized 230 x 264

22. Country Section Banner Advertising

  • 22.1. This product is subject to the Terms and Conditions for all Propertyshowrooms.com Mail shots, and Terms and Conditions for all Propertyshowrooms.com Banner Advertisements – In General, and, in addition, is subject to the additional specific terms of this service outlined below and associated with this enhancement.
  • 22.2. The price of a rotating banner is determined by the tier of the country.
  • 22.3. Propertyshowrooms.com will drive traffic to The Advertiser’s website or chosen landing page from a rotating banner on the ancillary pages of Propertyshowrooms.com for the country of The Advertiser’s Choice.
  • 22.4. The Banner will be displayed on all ancillary pages (such as mortgage pages for the Advertisers’ chosen country etc.) and guide pages (such as healthcare and cuisine pages).

23. Showcase Banner Advertisements - Mailshots

  • 23.1. This product is subject to the Terms and Conditions for all Propertyshowrooms.com Mail shots, and Terms and Conditions for all Propertyshowrooms.com Banner Advertisements – In General, and, in addition, is subject to the additional specific terms of this service outlined below and associated with this enhancement.
  • 23.2. Side banners should be provided in the size of 151 x 214
  • 23.3. Side banners are priced at 150 Euros per advert
  • 23.4. Bottom banners should be provided in the size of 792 x 154
  • 23.4 Bottom banners are priced at 200 Euros per advert

24. Solus E-mail Campaigns

  • 24.1. This Product is subject to the Terms and Conditions for all Propertyshowrooms.com Mailshots, and, as such is subject to the terms of this service in addition to the specific terms, outlined below, associated with his product.
  • 24.2. All mailers will have a Propertyshowrooms.com logo and clickthrough link on them.
  • 24.2.1. Propertyshowrooms.com will send a mailshot regarding The Advertiser’s product to the Propertyshowrooms.com database.
  • 24.2.2. Propertyshowrooms.com will include The Advertiser’s company name, and a link to The Advertiser’s website, or a landing page of The Advertiser’s choice (which may or may not be hosted on Propertyshowrooms.com) on a designed email campaign sent to the Propertyshowrooms.com opt-in investor database.
  • 24.2.3. Traffic will be driven toward The Advertiser’s website or The Advertiser’s desired landing page, and Propertyshowrooms.com will be able to quote click through and open rates upon request (after at least 72 hours), allowing The Advertiser to see exactly how successful the mail out is.
  • 24.3. All mailers must connect through to the relevant page for the promoted product in question.
  • 24.3.1. The Advertiser cannot send a mailshot relating to property and link through to a different product, e.g. financial etc.
  • 24.4. Mail shots are limited so that no country is promoted more than once in any two Week period. I.e. no other mailshot will be sent for the same country 1 week either side of the Advertisers mailshot.
  • 24.4.1. To prevent over-saturation of the database, no more than 3 mail shots can be booked by any one agent or developer at one time. (Exceptions may be made for multi-regional/country developer/agents).
  • 24.5. All the required information for each campaign MUST be provided to Propertyshowrooms.com 1 calendar week (7 days) prior to the launch of and must meet with the technical specifications detailed below.
  • 24.5.1. Propertyshowrooms.com will then return the copy to The Advertiser within one full business day. From here The Advertiser will have one business day to proof read the final copy and return to Propertyshowrooms.com.
  • 24.5.2. Note: After proof reading the final copy The Advertiser will not be able to make any further changes to The Advertiser’s mail out - ready for Propertyshowrooms.com to send out on the day detailed in the agreement.
  • 24.5.3 A Propertyshowrooms.com Solus send slot can only be booked by payment in advance, at least 2 weeks prior to the send date (unless otherwise agreed in writing with an authorised member of the Propertyshowrooms.com team).
  • 24.5.4 Once the mail shot date is booked, a minimum of 2 weeks notice will be needed to change the date of the mail shot.
  • 24.5.5 A minimum of 2 weeks notice is required to cancel a booked and paid mailshot date, otherwise the Advertiser shall have no recourse for a refund.
  • 24.5.6 No refund will be given if the fully-approved content for the mailshot is not supplied by the Client/Advertiser 1 calendar week (7 days) before the scheduled mailshot date.
  • 24.6. Additional charges may be incurred on highly complex requests for email campaigns. These will be agreed in writing between the Client and Propertyshowrooms.com / Global Prospects.
  • 24.7. The Advertiser will provide a minimum of one email address, one phone number and one contact name with whom Propertyshowrooms.com may correspond to forward enquiries.

  • 24.8 Mailshot requirements and specifications for Propertyshowrooms.com Solus Email Campaigns
  • 24.8.1. Any test e-mail addresses that The Advertiser requires proofing in.
  • 24.8.2. A subject line for the e-mail.
  • 24.8.3. The address (URL) of the page on The Advertiser’s site where The Advertiser would like the traffic to arrive (unless a Propertyshowrooms.com landing page is to be used).

  • 24.9 Content may be supplied either;
  • 24.9.1. Using an html mailer of The Advertiser’s own with the following criteria;
  • 24.9.2. A Zip file containing all the relevant data, text and images, no larger than 600k in total.
  • 24.9.3. All formatting must be inline.
  • 24.9.4. Mailer must be ideally 600px wide, but no more than 800px wide.

  • 24.10 OR
  • 24.10.1. Separate text and images for use in our template. (Please note there is a 50 Euro surcharge)
  • 24.11. In our template The Advertiser will need to comply with the following.
  • 24.11.1. 1 x banner image or logo. Minimum size to be no less than 600 X 400px.
  • 24.11.2. 2 x images. Minimum size no less that 400px X 400px.
  • 24.11.3. Text must to be checked prior to submission for spelling and grammatical errors in the English Language (UK), 300 words maximum.
  • 24.11.4. Propertyshowrooms.com will need a clear headline for the body of the actual mail itself.

  • 24.12 General Recommendations.
  • 24.12.1. Images – The larger the images The Advertiser can supply the better.
  • 24.12.2. Text – Keep it short, to the point and uncomplicated (300 words maximum).
  • 24.12.3. Bullet point the text - Maximum 5 points.

25. Featured Properties

  • 25.1. This product is an enhancement to the Propertyshowrooms.com listing service. It is subject to the Terms and Conditions of Propertyshowrooms.com listing service for FSBO / Agents / Developers, in addition, is subject to the additional specific terms of this service outlined below and associated with this enhancement.
  • 25.2. Properties displayed as Featured Property will appear at the top of such search result pages, depending on whether selected at Country, Region or Town Level.
  • 25.2.1. Property set at Country Level will be displayed on all property search result pages on Propertyshowrooms.com as well as most ancillary pages for The Advertiser’s chosen Country – These include most of the Property ancillary pages (such as mortgage pages for the Advertisers’ chosen country etc.) and most guide pages (such as healthcare and cuisine pages). A maximum of 3 properties at any one time can be set at Country Level.
  • 25.2.2. Property set at Region Level will be displayed on all property search result pages at Region and Town level. A maximum of 3 properties at any one time can be set at Region Level.
  • 25.2.3. Property set at Town Level will be displayed on all property search result pages for The Advertiser’s chosen Town. A maximum of 3 properties at any one time can be set at Town Level.
  • 25.3. All Featured Property allocation is on a first come first served basis.
  • 25.4. All Featured Properties must connect through to the relevant property details page.
  • 25.5. Featured Properties must be paid for in advance. A pro-forma invoice will be issued and once payment has been confirmed by means of credit card receipt of bank transfer confirmation, the property will be uploaded to the relevant Level within 24 hours.
  • 25.6. Propertyshowrooms.com reserves the right to refuse Featured Properties in the interest of the Propertyshowrooms.com website.
  • 25.6.1. All Featured Properties should be of a suitable standard to be launched and Propertyshowrooms.com reserves the right to reject Featured Properties on this basis.
  • 25.7. Whilst Propertyshowrooms.com makes every effort to keep its Featured Properties accurate and up to date, Propertyshowrooms.com accepts no responsibility for click through or conversion rate.
  • 25.7.1. Any figures quoted with respect to the database are approximate at that time and relevant to previous experience with similar products.
  • 25.8. Propertyshowrooms.com accepts no responsibility for errors/mistakes/inaccuracies within the Featured Property advertisement.
  • 25.9. The Advertiser is responsible for making sure the price and description are displaying correctly.
  • 25.9.1. Descriptions are imported from the “property headline” field in the manual uploader or directly from the agents feed.
  • 25.10. List prices are subject to alteration without notice and confirmation of list prices should be sought by The Advertiser when placing the order.
  • 25.11. Any variation of these conditions by The Advertiser is ineffective unless accepted in writing by a senior employee of Propertyshowrooms.com / Global Prospects.
  • 25.12. Quotations lapse after 30 days unless re-confirmed in writing by Propertyshowrooms.com / Global Prospects.

26. Ancillary Packages

  • 26.1. All Ancillary packages must be paid for in advance
  • 26.2. The Advertiser signing up to use the Propertyshowrooms.com Ancillary packages is a company working in with a real estate associated business and has the ability to promote their services through www.propertyshowrooms.com
  • 26.3. Propertyshowrooms.com will provide The Advertiser with an advert on all ancillary pages for the appropriate country section of Propertyshowrooms.com (such as mortgage pages for the Advertisers’ chosen country etc.) and guide pages (such as healthcare and cuisine pages).
  • 26.4. Propertyshowrooms.com will drive traffic to The Advertiser’s website or chosen landing page from an advert on the ancillary pages of Propertyshowrooms.com for the country of The Advertiser’s Choice.
  • 26.5. Propertyshowrooms.com will provide an opt-in tick box for property enquirer’s to receive further information on The Advertisers services/products when making property enquiries
  • 26.6. The Advertiser will receive all direct enquiries made to Propertyshowrooms.com for their particular country, for their particular service/product
  • 26.7. The price of the Ancillary package is determined by the tier of the country.
  • 26.8. Propertyshowrooms.com will provide The Advertiser with a Banner of The Advertiser’s choice on the Propertyshowrooms.com Showcase mailer once a month
  • 26.9. An invoice will be issued and once payment has been confirmed, either by credit card authorisation or bank transfer confirmation, the date for the Showcase banner will be confirmed and design work will be commenced by Propertyshowrooms.com.
  • 26.10. Propertyshowrooms.com accepts no responsibility for errors/mistakes/inaccuracies within the design of the advertisement after Propertyshowrooms.com receives written confirmation from The Advertiser that the mailer has been “approved”.
  • 26.11. The Advertiser must be able to provide proof where requested that he has authorization to market the properties and/or provide the service that he is advertising through Propertyshowrooms.com and that any properties/services adhere to local regulations (e.g. decree 218 in Spain – where it is necessary to hold hard copies of owners title deeds to the property etc. – or FSA regulation for financial products).

  • 26.14. If Propertyshowrooms.com is preparing the artwork for The Advertiser’s rotating banner a minimum of 5 working days must be allowed for Propertyshowrooms.com to prepare The Advertiser’s advert and for The Advertiser to approve
  • 26.15. The Advertiser must also provide their logo and the URL (the website address) of the page where the rotating banner will link through to.
  • 26.16. Additional charges may be incurred on highly complex requests for Banner Advertising. These will be agreed in writing between The Advertiser and Propertyshowrooms.com / Global Prospects.
  • 26.17. Propertyshowrooms.com accepts no responsibility for undelivered click through’s or page views due to problems with the advertiser’s server.
  • 26.18. The Advertiser should reply to all enquiries as soon as is practical to ensure that clients receive details as they request.
  • 26.19. By submitting advertising content to Propertyshowrooms.com The Advertiser confirms that he is the owner of the material being submitted, in doing so, The Advertiser allows Propertyshowrooms.com to use this material, and submit it to third parties for publicity purposes, where applicable, within the interest of promoting The Advertisers properties/services
  • 26.20. Propertyshowrooms.com will send renewal reminders to The Advertiser 14 days, 7 days and 3 days prior to the renewal date of the advert. To do this The Advertiser will need to log in and resubmit the advertiser’s payment details.
  • 26.21. Propertyshowrooms.com will endeavour to filter out spam, invalid or fraudulent enquiries, however, Propertyshowrooms.com can make no guarantee for the legitimacy of internet based enquiries.

27. Marketing Packages

  • 27.1. Marketing packages are a composition of: Showcase Property Advertisement, Showcase Banner Advertisement, Featured Property and Banner Advertisement on the relevant country section.
  • 27.2. As such, they are subject to the terms and conditions stated above for each individual product.
